Height limits

Section 30.140.110 of the inland zoning code (Title 30, as amended in 2026; the city says these amendments took effect May 28, 2026) sets heights in Table 30.140.110.C [1]:

  • Within 10 ft of the front lot line: fence 3.5 ft, retaining wall 3 ft, hedge 8 ft.
  • Rest of the front yard: fence 5 ft, retaining wall 3 ft, hedge 8 ft.
  • All other areas (side and rear): fence 8 ft, retaining wall 6 ft, hedge 12 ft.

Pilaster caps, finials, posts and lights may extend up to 12 inches higher. One entry arbor or gate per lot line is allowed in setbacks, up to 9 ft tall.

Going taller

A Minor Zoning Exception from the Design Review body can allow fences up to 7.5 ft near the front lot line and 12 ft elsewhere, if sightlines for drivers aren't blocked [2]. Anything taller needs a Modification.

Corners and driveways

Where a driveway crosses the front property line on a street with a sidewalk and parkway, nothing may block visibility above 42 inches within a triangle 10 ft from the side of the driveway and 10 ft back from the front lot line [4]. At street intersections, the Public Works Director sets the sight distance, and structures or landscaping in it must also stay under 42 inches.

Materials and finish

Allowed materials include plastered masonry, stone, stucco, wrought iron, black or dark green painted metal, and stained or painted wood in earth tones. Fences must be double-sided or finished on the side facing the street or neighbor [3]. Chain link and vinyl are prohibited in residential front yards unless Design Review approves [5]; barbed wire, corrugated metal and razor wire are prohibited in residential zones.

Permits

Residential fences and walls up to 5 ft are exempt from a building permit if they comply with the Fence and Hedge Ordinance [6]. That's lower than the state's 7-ft default, so a 6- to 8-ft backyard fence needs a building permit. Retaining walls up to 4 ft are also generally exempt.

Coastal zone

These are Title 30 rules for areas outside the coastal zone. Coastal properties follow Title 28, which we didn't have.

Next steps

  1. Check whether your lot is inland (Title 30) or in the Coastal Zone (Title 28) using the City's MAPS viewer or Accela Citizen Access.
  2. Measure where the fence will go relative to the front lot line, front yard and any driveway sight triangle.
  3. For a fence over 5 ft, apply for a building permit with the Building & Safety Division at 630 Garden St.
  4. For extra height beyond the table, apply to Planning for a Minor Zoning Exception through Design Review.

California state rules on fences

Fence height, location and design are mostly set by your city or county zoning code. A few state rules apply everywhere:

  • Building permit: the California Residential Code (R105.2) exempts fences up to 7 feet high from a building permit. Pool barriers are not exempt. Zoning height limits still apply, and many cities cap front-yard fences well below 7 feet. Some cities have amended the exemption.
  • Spite fences: under Civil Code §841.4, a fence or fence-like structure that unnecessarily exceeds 10 feet and is maliciously put up or kept to annoy a neighbor is a private nuisance. The neighbor can sue to have it removed.
  • Good Neighbor Fence Act (Civil Code §841): since January 1, 2014, neighbors are presumed to share equally the reasonable cost of building, maintaining or replacing a fence between their properties, unless they agree otherwise in writing.
    • Before spending money on a shared fence, you must give each neighbor 30 days' written notice. The notice must describe the problem, the proposed fix, the estimated cost, how costs would be shared, and the timeline.
    • A neighbor can overcome the presumption in court by showing equal sharing would be unjust, for example because of financial hardship or costs driven by the other owner's aesthetic preferences.
  • Pool fences must meet the Swimming Pool Safety Act's barrier standards when used as the pool enclosure (see Pools).
  • Coastal zone: a new fence may need a coastal development permit, depending on the local coastal program.
