Rockport, Knox County · Ordinances checked 2026-10-01 · Reviewed · 10 cited sections

Allowed with a permit

Yes. Home occupations are a permitted use throughout Rockport's residential and village districts, but you need a use permit from the Code Enforcement Officer and must meet the Section 811 standards: the business must be inside the home or an accessory building, use no more than 50% of the floor area, and involve no more than six people, at most two from outside the family. Projects generating more than 20 business vehicle trips a day need Planning Board site plan review.

Do you need approval?

The Land Use Table lists Home Occupations as permitted (P) in every zoning district except Industrial [9]. Even so, Section 811 says no use permit will be granted for a home occupation in any district unless it meets each of the listed criteria, so you apply to the Code Enforcement Officer [1]. A home day care serving 12 or fewer children counts as a home occupation [1]. Starting July 1, 2027, a state law (30-A M.R.S. §4364-D) requires towns to treat family child care homes as a permitted residential use under the same rules as a single-family home, which may override the home-occupation limits for small in-home day cares.

Main standards

  • The business must be carried on wholly within the residence or an accessory building and remain incidental to the home's residential use [2].
  • No more than six people may be engaged in the home occupation, and no more than two of them may be from outside the family [3].
  • No exterior display, exterior storage, or other outside sign of the business beyond what the district sign rules allow [4].
  • No nuisance, noise, smoke, odors, glare, traffic or parking problems, and no large-scale commercial or industrial machinery.
  • You must provide off-street parking for each employee and for the maximum number of customers at peak hours, in addition to the home's normal parking [5].
  • You may sell items actually produced on the premises, and the business may use no more than 50% of the total floor area of the dwelling and accessory structures [6].

When site plan review applies

If the business is expected to generate more than 20 business vehicle trips per day, it requires site plan review by the Planning Board [7].

Signs

In the Harbor Village, Village, Residential Coastal, Residential, Rural and Traditional Village districts, total sign area on a parcel is limited to 12 square feet [8].

Shoreland zone

In the Shoreland Zoning Overlay, home occupations need a CEO permit in all shoreland districts [10].

Maine state rules for home businesses

Maine has no statewide home-occupation law. Whether you can run a business from home, and with what limits, is mostly up to your town's zoning. A few state rules may apply:

  • Sales tax registration: If you regularly sell taxable goods or services from home, you must register with Maine Revenue Services and collect sales tax.
  • Home food businesses: Making shelf-stable foods (baked goods, jams and similar) to sell requires a Home Food License from the Maine Department of Agriculture, Conservation and Forestry. It costs $20 a year and needs an initial kitchen inspection. Foods that must be refrigerated need a commercial license instead.
  • Family child care: A state law (30-A M.R.S. §4364-D) makes family child care providers a permitted use in residential zones, under the same zoning rules as a single-family home. As amended in 2026, towns must follow it starting July 1, 2027. State child care licensing applies separately.
  • Shoreland zone: The DEP's model shoreland ordinance defines a home occupation as one clearly incidental to the home, with no more than 2 employees besides family members living there. It requires a planning board permit in Limited Residential, Resource Protection and Stream Protection districts, and a code officer permit in Limited Commercial districts.
