Fence height rules in Dennis, Massachusetts

Dennis, Barnstable County · Bylaws checked 2026-10-15 · Reviewed · 6 cited sections

Depends on your zone

South of Route 6, a typical fence needs no zoning approval: Dennis's zoning bylaw sets no fence height limit or setback (fences aren't "structures" under it), and its only fence rule is a corner-lot sight triangle (nothing over 2½ feet above street grade within 20 feet of the intersection). North of Route 6 you're in the Old King's Highway Historic District, where every fence needs a certificate from the Dennis OKH Committee; wooden fences 4 feet or lower in listed styles can get a certificate of exemption without a hearing, and others need full review.

What the zoning bylaw says

The Dennis Zoning By-Law has no general height limit or property-line setback for residential fences. Its one fence rule is a corner-lot sight triangle: no fence, wall, hedge or shrub may block vision more than 2½ feet above street grade inside the triangle formed by the two street lines and a line joining points 20 feet from their intersection [1]. The bylaw's definition of "structure" excludes fences [2], so the setbacks for structures don't appear to apply to them. The bylaw's yard definition likewise lists fences as an allowed yard feature.

Old King's Highway Historic District (north of Route 6)

The part of Dennis north of the Route 6 (Mid-Cape Highway) center line is in the Old King's Highway Regional Historic District [3]. Under the district act, fences count as "structures" (along with stone walls, hedges and gates), and nothing may be erected until the Dennis OKH Committee issues a certificate of appropriateness or a certificate of exemption. The building inspector can't issue a permit without one [4]. The Commission lists wooden fences 4 feet or lower as eligible for an exemption without a hearing, if they suit the site, have the finished side facing out, and use one of the listed styles: natural post-and-rail, white or natural square rail or picket, or flat board with a cap rail [5]. A site plan is required. Taller fences, other materials or other styles go through a full certificate-of-appropriateness review. Features not visible from a way or public place can also be exempted with a site plan.

Floodplain and wetlands

In the floodplain overlay district, a permit is required for development, including fences [6]. Fence work near wetlands may also need Conservation Commission review.

State building-code and spite-fence rules still apply (see the state section). Check with the Building Department before you build.

Massachusetts state rules on fences

Most fence rules in Massachusetts are local, set in your town's zoning bylaw and sometimes historic-district rules. A few state laws apply everywhere:

  • Building permit: the State Building Code (780 CMR, 10th edition) does not require a building permit for fences 7 feet high or less. Taller fences need one. Zoning height limits and setbacks still apply, and many towns cap fences at 6 feet.
  • Spite fences: under M.G.L. c. 49, §21, a fence that unnecessarily exceeds 6 feet and is maliciously put up or kept to annoy a neighbor is a private nuisance. The neighbor can sue for damages.
  • Fence viewers: every town must appoint fence viewers each year (c. 49, §1). Where adjoining owners both enclose and use their land, they share the upkeep of the partition fence equally unless they agree otherwise. If one side won't repair their share, the other can complain to the fence viewers, who can order the repair (c. 49, §§3–4). By statute, a "legal and sufficient" fence is 4 feet high and in good repair (c. 49, §2).
  • Pool fences must meet the state pool barrier rules (see Pools).
  • Wetlands: fence work in a wetland or within 100 feet of one may need Conservation Commission review.
