Swimming pool rules in Mashpee, Massachusetts
Private pools are allowed in every Mashpee zoning district but need a building permit ($150 in-ground, $100 above-ground, plus a $75 electrical permit). Every private outdoor pool must be fenced to the State Building Code under General Bylaw §153-1. Zoning applies its setbacks to accessory uses (40 ft front, 15 ft side and rear in R-3 and R-5), and the 50-ft setback from water and wetlands for structures likely applies too; confirm with the Building Commissioner.

Zoning
The use table marks a private greenhouse, stable, tennis court, swimming pool or similar structure for domestic use "Y" (allowed) in all six districts [1]. The Land Space Requirements apply to accessory uses [7]; in R-3 and R-5 that means 40 ft from the front line and 15 ft from side and rear lines [8]. Any building or structure (other than docks and piers) must also be at least 50 ft from water or wetlands [9]; the bylaw doesn't say directly whether an in-ground pool is a "structure" for this rule. The zoning bylaw doesn't have a separate pool-specific setback, so confirm the measurement with the Building Commissioner.
Permits and fees
The Building Department lists above-ground and in-ground swimming pools among projects needing a permit [2]. Fees are $150 for an in-ground pool and $100 for an above-ground pool [3], plus $75 for the residential electrical permit [4]. Apply through PermitEyes with a certified site plan.
Fencing
General Bylaw §153-1 requires every private outdoor pool to be fenced to prevent unauthorized entry, following the Massachusetts State Building Code [5]; violations carry a fine of up to $20 each [6]. The barrier details (height, gates) come from the state code; see the state rules on this page.
Inspections
The Building Department's inspection sequence is: rough pool inspection after the wiring inspector checks bonding; electrical bonding and apron inspections; an as-built uploaded before the final; and a final inspection that includes alarms, retractable covers and fencing [10].
Near wetlands or in flood zones
Near wetlands, a pool also needs Conservation Commission review; the Commission's flood-zone regulation evaluates new pools case by case and requires mitigation plantings for added structures. In the Historic District, a pool visible from a public way may need a certificate.

Massachusetts building code rules for pools
Under the State Building Code (780 CMR, 10th edition), residential pools, spas and hot tubs must meet the 2021 International Swimming Pool and Spa Code (ISPSC) as adopted in Massachusetts.
Permits:
- A building permit is needed for any pool except prefabricated pools under 24 inches deep.
- Plans for in-ground pools must be prepared by a registered design professional (an engineer or architect).
- Wiring must meet the Massachusetts Electrical Code (527 CMR 12.00), and gas pool heaters must meet the state plumbing and gas code (248 CMR).
Barrier (fence) requirements (ISPSC §305):
- The barrier must be at least 48 inches high, measured on the side away from the pool.
- The gap under the barrier can be no more than 2 inches over grass or gravel, or 4 inches over concrete.
- Pedestrian gates must open outward away from the pool, be self-closing and self-latching, and be able to take a lock.
- If a house wall forms part of the barrier, doors and low windows opening to the pool need an audible alarm (or another listed option).
- In-ground pool construction sites need temporary fencing at least 4 feet high from excavation until the permanent barrier is up.
- Spas and hot tubs with a lockable safety cover meeting ASTM F1346, and pools with a powered safety cover meeting that standard, are exempt from the barrier rules.
Local zoning still controls pool setbacks, and wetlands rules may apply near water.
