Wayland's Building Department says every shed needs a building permit, whatever its size, with a minimum $100 fee for a residential shed. A shed may go in the rear yard 10 feet or more from the property line; anywhere else it has to meet your zone's regular setbacks (30 feet front and rear, and 15 to 30 feet on the sides depending on the zone).

Permit

The Building Department's shed guidance says all sheds need a building permit, regardless of size. It defines a shed as a 1 1/2-story unconditioned accessory structure [1]. You submit a Shed Permit Application with a site or plot plan. The minimum fee is $100 when construction costs less than $5,000 for a shed accessory to a house [2]. For sheds larger than 200 square feet, or built on footings, the Health Department may need to pre-approve the location, mainly to keep it off the septic system [5]. For any size, check with the Conservation Department about conservation restrictions on the spot you've chosen. The Building Department may ask a land surveyor to verify the location.

The State Building Code exempts one-story sheds of 200 sq ft or less from a building permit. Wayland's local guidance says otherwise, so ask the Building Department which applies before you skip the permit.

Where it can go

Shed location rules are in Zoning Bylaw §198-703.1, which we couldn't get. The Building Department summarizes the key exception: sheds may go in the rear yard only, 10 feet or more from the verified property line, instead of meeting the full setbacks in the Table of Dimensional Requirements [3]. Outside that rear-yard exception, the table's minimums for the four single-residence zones are 30 feet from the street line (55 feet from the street center line) in front and 30 feet in the rear. Side setbacks are 15 feet in R20, 20 feet in R30, 25 feet in R40 and 30 feet in R60. Lot coverage is capped at 20% in all four zones [4]. Footnotes say other zoning sections (§198-702 and §198-703.2) can change these setbacks.

The table caps buildings at 35 feet and 2 1/2 stories. The bylaw section with any lower height limit for accessory structures (§198-703.1) wasn't available to us.

Your zone (R20, R30, R40 or R60) is listed under Land Use in the Assessor's online property database. Put the proposed front, side and rear setbacks on both the permit application and the plot plan.

Massachusetts building code rules for sheds

The Massachusetts State Building Code (780 CMR, 10th edition) sets when a shed needs a building permit. Your town's zoning sets where it can go.

  • No building permit needed for a one-story detached accessory structure used as a tool or storage shed, playhouse or similar, if the floor area is 200 sq ft or less (Residential Code R105.2).
  • Bigger sheds, or any with more than one story, need a building permit from your local building department.
  • Also exempt from a building permit: detached decks of 200 sq ft or less that are no more than 30 inches above grade, and greenhouses covered only in plastic film.
  • The exemption covers only the building permit. Electrical, plumbing or gas work in the shed still needs its own permits, and the shed still has to meet local zoning (setbacks, lot coverage, height). Many towns set accessory-structure setbacks even for small sheds.
  • Wetlands: putting a shed in a wetland resource area or within 100 feet of a wetland (or 200 feet of a river) may require Conservation Commission approval first, whatever its size.

The 10th edition took effect October 11, 2024 and has been the only code in force since July 1, 2025.
