Allowed with a permit

Yes. A private backyard pool needs no zoning approval in Los Gatos, but it must be at least 5 feet from property lines and out of the required front yard and street-side yard. Every pool or spa must be fully enclosed by a barrier at least 5 feet high with self-closing, self-latching gates, and the Building Division won't final the pool until it is.

Do you need approval?

Pools are allowed in all zones. A pool used incidentally to a home, such as a private backyard pool, needs no zoning approval [3]; pools at clubs or charging admission need a conditional use permit. The zoning code defines a swimming pool as any built or prefabricated pool 24 inches or more deep [8]. Construction still goes through the Building Division, which won't give final inspection and approval until the enclosure requirements are met [7].

Where it can go

A pool can't be within 5 feet of a property line, in a required front yard, or in a required side yard along a street [1]. Pool pumps and other mechanical equipment can't be in a required front yard, and must be at least 10 feet from the property line if placed in a required side yard [2].

Fence and barrier

Anyone with a pool or spa must keep it completely enclosed by a fence, wall, hedge or structure at least 5 feet high, with no openings over 4 inches [4]. Gates must be self-closing and self-latching with the latch at least 3.5 feet above the deck, and the bottom of the fence must be within 4 inches of grade [5]. A separate subsection requires gate and door latches at least 4 feet 9 inches above ground or otherwise out of children's reach [6]; follow the stricter figure. A house wall can form part of the enclosure, and the Building Official may accept natural barriers or a load-bearing listed pool cover. Pools on single-family parcels of 5 acres or more, at least 200 feet from property lines and screened from the street, are exempt from the enclosure rule [9], but need a permit from the Building Official.

Hot tubs and state rules

Spas and hot tubs fall under the same enclosure rule [4]. This section dates from 1991; California's Swimming Pool Safety Act now also requires two drowning-prevention features for new or remodeled residential pools and spas and sets higher latch heights, so state law may override the lower local latch heights.

California state rules for swimming pools

Pools need a city or county building permit, and local zoning sets setbacks. The state's Swimming Pool Safety Act (Health & Safety Code §115920 et seq.) adds safety rules:

  • Drowning prevention features: when a building permit is issued for a new pool or spa, or to remodel one, at a private single-family home, it must have at least two of seven safety features (§115922):
    1. an enclosure that isolates the pool from the house
    2. removable mesh fencing (ASTM F2286) with a self-closing, self-latching gate
    3. a safety pool cover (ASTM F1346-23)
    4. exit alarms on doors and windows that open directly to the pool
    5. self-closing, self-latching devices on those doors, released at least 54 inches up
    6. a pool alarm (ASTM F2208; child-worn alarms don't count)
    7. other equally protective, independently verified means
  • Some pairs don't count, such as a safety cover plus a pool alarm. The building official inspects before final approval.
  • Enclosure standards (§115923): at least 60 inches high, no more than 2 inches of clearance at the bottom, gaps that won't pass a 4-inch sphere, no handholds or footholds, and gates that open away from the pool with self-latches at least 60 inches up.
  • What counts as a pool: any structure with water over 18 inches deep, including above-ground pools, hot tubs and spas (§115921). Spas with a locking ASTM F1346 cover, apartment complexes and public pools are exempt (§115925).
  • Small pools: the 2025 Residential Code exempts prefabricated pools under 24 inches deep from a building permit.
