Allowed use

Saratoga's R-1 districts list swimming pools used solely by residents and their guests as a permitted use [1], and the Agricultural district does the same. Structures housing pool equipment are permitted accessory structures. A pool needs a building permit from the Building Division; the City Code sections we reviewed don't spell out the permit process.

Setbacks

No swimming pool or pool equipment may be placed in a required front, side or rear setback area unless an exception applies [2]. The main exception: a pool and its equipment may be in the required rear setback area, but the water line must be at least 6 feet from any property line, and any part of the pool outside the rear setback must meet the side setback for the site [3]. Pool equipment may go in an interior side setback only where that setback is more than 10 feet, and then no closer than 10 feet to the side lot line [4]. An enclosed pool-equipment structure of up to 250 square feet can also be placed in the rear setback, at least 6 feet from the lot lines, with Community Development Director approval.

Fencing and safety

Fences required around pools are governed by the California Building Code and, in hillside districts, City Code Sec. 15-29.020(e) [5]. In HR and R-OS hillside districts, where fencing on a site is otherwise limited to enclosing 6,000 square feet or 15 percent of the site, an extra pool fence may be added if it follows the pool's contour within 10 feet of the water's edge. State law also requires two drowning-prevention safety features for new pools and spas at single-family homes.

Slopes and grading

No pool may be built where the average natural grade under its footprint exceeds 30 percent slope, or on any spot steeper than 40 percent, without a variance or subdivision exception [6]. On hillside lots in the Agricultural district, combined cut and fill including pool excavation is capped at 1,000 cubic yards unless the Planning Commission approves more. The code we reviewed has no separate rules for above-ground pools or hot tubs; the setback rules apply to any swimming pool.

California state rules for swimming pools

Pools need a city or county building permit, and local zoning sets setbacks. The state's Swimming Pool Safety Act (Health & Safety Code §115920 et seq.) adds safety rules:

  • Drowning prevention features: when a building permit is issued for a new pool or spa, or to remodel one, at a private single-family home, it must have at least two of seven safety features (§115922):
    1. an enclosure that isolates the pool from the house
    2. removable mesh fencing (ASTM F2286) with a self-closing, self-latching gate
    3. a safety pool cover (ASTM F1346-23)
    4. exit alarms on doors and windows that open directly to the pool
    5. self-closing, self-latching devices on those doors, released at least 54 inches up
    6. a pool alarm (ASTM F2208; child-worn alarms don't count)
    7. other equally protective, independently verified means
  • Some pairs don't count, such as a safety cover plus a pool alarm. The building official inspects before final approval.
  • Enclosure standards (§115923): at least 60 inches high, no more than 2 inches of clearance at the bottom, gaps that won't pass a 4-inch sphere, no handholds or footholds, and gates that open away from the pool with self-latches at least 60 inches up.
  • What counts as a pool: any structure with water over 18 inches deep, including above-ground pools, hot tubs and spas (§115921). Spas with a locking ASTM F1346 cover, apartment complexes and public pools are exempt (§115925).
  • Small pools: the 2025 Residential Code exempts prefabricated pools under 24 inches deep from a building permit.
