Allowed as an accessory use

Garden sheds, greenhouses, shade structures, hobby shops and pool equipment enclosures are all listed as permitted accessory structures in Saratoga's R-1 districts [1]. Accessory structures may not exceed 15 feet in height, although the Planning Commission can approve up to 20 feet for architectural compatibility with the house [2]. Accessory structures also count toward the district's site coverage limit, which the code's table sets at 60 percent in R-1-10,000 down to 35 percent in R-1-40,000 [6].

Setback areas

As a rule, no enclosed accessory structure may be placed in any required setback area [3]. Outside the setbacks (for example, more than 25 feet from the rear line on a typical R-1-10,000 interior lot), a shed only has to meet the general height and coverage limits. The main exception for small structures: with approval from the Community Development Director, garden sheds, pool-equipment enclosures and similar structures of up to 250 square feet may sit in the rear setback area if they are at least 6 feet from the side and rear property lines. They may be 6 feet tall at that line, plus 1 foot for each additional foot of setback, up to 10 feet [4]. This exception does not cover structures used to keep animals.

Larger enclosed buildings in the rear setback, such as garages, cabanas, recreation rooms and hobby shops, need a Planning Commission use permit, must stay 6 feet from the side and rear lines, and are limited to 8 feet tall, rising 1 foot for each 3 feet of extra setback to a maximum of 10 feet [5]. Unenclosed structures such as gazebos, arbors and play structures follow a similar 6-foot rule with an 8-foot base height. The Planning Commission can grant exceptions to size, height and setback through a use permit.

Building permits and design review

The City Code sections we reviewed do not set a shed size that triggers a building permit; under the state residential code, one-story storage sheds of 120 square feet or less are generally exempt. New or expanded accessory structures in R-1 must also comply with any applicable design review rules in Article 15-45, which we did not review.

California state rules for sheds and accessory buildings

Where a shed can go (setbacks, height, lot coverage, front-yard limits) is set by your city or county zoning code. The state sets the building-permit baseline:

  • Permit exemption: the 2025 California Residential Code (R105.2) exempts one-story detached accessory structures used as tool and storage sheds, playhouses and similar uses if the floor area is 120 sq ft or less. Bigger sheds need a permit, and electrical or plumbing work needs its own permit. Some cities have amended these thresholds.
  • Other exempt work in the same list includes fences up to 7 ft and decks up to 200 sq ft that are no more than 30 inches above grade and not attached to the house.
  • Exempt doesn't mean unregulated: zoning setbacks, HOA rules and easements still apply, and some cities require a zoning clearance even for small sheds.
  • Turning a shed or garage into living space is covered by the state's ADU law (Gov. Code §66314). An existing accessory structure converted to an ADU needs no added setback, and new ADUs need no more than 4-foot side and rear setbacks (see ADUs).
  • Wildfire areas: in a state responsibility area, owners must keep 100 feet of defensible space around buildings (Pub. Res. Code §4291). Local fire-hazard rules may limit what you can build or store near structures.
  • Coastal zone: a new structure is "development" and may need a coastal development permit (Pub. Res. Code §30106).
