Zoning

Private swimming pools are an allowed accessory use in the R-1A, R-1B and RA districts and the Downtown Residential sub-district [6]. On a lot with an accessory dwelling unit, the zoning bylaw allows no more than one swimming pool.

Pool fencing bylaw

Under Chapter XV of the Town By-Laws, every outdoor pool deeper than 18 inches at any point must be enclosed by a fence or wall at least four feet high with a self-latching, self-closing gate, and gates must be kept closed when not in use [1]. Openings in the enclosure can be no larger than 2 inches wide by 4 inches high [2]. The side wall of an above-ground pool counts as the barrier if it is at least four feet high and the pool has a retractable ladder [3]. The Building Inspector may approve substitute barriers that give equal protection and may allow temporary fencing during construction. A house or other building can form part of the enclosure. Violations carry a fine of up to $50 per day.

Building Department requirements

The Building Department's pool handout (a scanned document; our copy is OCR text) says a permit is required before installing, altering or enlarging a pool, with two sets of plans and a certified plot plan. It sets these locations: the pool and any structural deck at least 12 feet from the house, 20 feet from the side and rear property lines and 25 feet from the front property line [4]. It also lists septic setbacks (in-ground pools 20 feet and above-ground pools 10 feet from a leaching field) and says no occupancy certificate will be issued until the fence enclosure is complete [5].

Hot tubs

The handout notes that spas and hot tubs with an approved safety cover are generally exempt from the barrier provisions. Doors from the house that open onto the pool area need an audible alarm, or the pool needs an approved power safety cover.

A pool within 100 feet of a wetland may fall in Hamilton's wetland no-build zone. Check with the Conservation Commission first.

Massachusetts building code rules for pools

Under the State Building Code (780 CMR, 10th edition), residential pools, spas and hot tubs must meet the 2021 International Swimming Pool and Spa Code (ISPSC) as adopted in Massachusetts.

Permits:

  • A building permit is needed for any pool except prefabricated pools under 24 inches deep.
  • Plans for in-ground pools must be prepared by a registered design professional (an engineer or architect).
  • Wiring must meet the Massachusetts Electrical Code (527 CMR 12.00), and gas pool heaters must meet the state plumbing and gas code (248 CMR).

Barrier (fence) requirements (ISPSC §305):

  • The barrier must be at least 48 inches high, measured on the side away from the pool.
  • The gap under the barrier can be no more than 2 inches over grass or gravel, or 4 inches over concrete.
  • Pedestrian gates must open outward away from the pool, be self-closing and self-latching, and be able to take a lock.
  • If a house wall forms part of the barrier, doors and low windows opening to the pool need an audible alarm (or another listed option).
  • In-ground pool construction sites need temporary fencing at least 4 feet high from excavation until the permanent barrier is up.
  • Spas and hot tubs with a lockable safety cover meeting ASTM F1346, and pools with a powered safety cover meeting that standard, are exempt from the barrier rules.

Local zoning still controls pool setbacks, and wetlands rules may apply near water.
