Allowed with a permit

Pools, spas and hot tubs are permitted accessory uses in San Clemente's residential zones and need a building permit. They can't go in the front or street-side setback without a Minor Exception Permit. A new pool must be fully enclosed by a barrier separating it from the house, plus have a second drowning-prevention feature. Pool equipment must be 5 ft from property lines and soundproofed.

Zoning

San Clemente's residential use table lists pools as a permitted accessory use, along with detached garages, sheds and gazebos [1]. Under Table 17.24.080B, pools, spas, hot tubs and other water features deeper than 18 inches can't encroach into the front setback or the street-side setback. Footnote 14 allows an exception with a Minor Exception Permit [2]. In the interior side and rear setback areas, the table defers to the setback required by the Building Code [3]. A Minor Exception Permit may also be needed for a pool enclosure tall enough to meet Building Code rules.

Pool equipment

Filters, heaters and pumps can't go in the front setback and must be 5 ft from the side and rear property lines. That distance can be reduced if the equipment is soundproofed and an approved acoustical report shows it [4].

Barriers and safety features

San Clemente amends the state Swimming Pool Safety Act in its building code (Municipal Code §15.08.070, CBC Section 3109). For a new or remodeled pool or spa at a single-family home, the pool must be fully enclosed by a barrier that meets Health & Safety Code §115923 and isolates it from the house and from neighbors and public ways. A second drowning-prevention feature is also required [5]. If the house forms part of the enclosure, two additional features are required. This is stricter than the state baseline, which lets you choose any two of seven features.

Where a barrier has vertical and horizontal members, the vertical members can be no more than 4 inches apart and the horizontal members at least 45 inches apart, so the barrier can't be climbed [6]. Decorative trim can't make it climbable.

Noise

Filters, heating systems and pumps for any pool, spa, hot tub or waterfall must be enclosed and soundproofed [7], unless an acoustical report shows compliance with the noise ordinance (Ch. 8.48).

Hot tubs

Spas and hot tubs deeper than 18 inches follow the same setback and barrier rules.

Next steps

  1. Draw a site plan showing the pool, the equipment location (5 ft from property lines) and the enclosure.
  2. Apply for a building permit with Building Services (949-361-6100), showing the full enclosure and the second drowning-prevention feature.
  3. Include soundproofing details or an acoustical report for the pump, filter and heater.
  4. If the pool or enclosure needs to be in the front or street-side setback, or the enclosure is taller than zoning allows, apply to the Planning Division for a Minor Exception Permit.

California state rules for swimming pools

Pools need a city or county building permit, and local zoning sets setbacks. The state's Swimming Pool Safety Act (Health & Safety Code §115920 et seq.) adds safety rules:

  • Drowning prevention features: when a building permit is issued for a new pool or spa, or to remodel one, at a private single-family home, it must have at least two of seven safety features (§115922):
    1. an enclosure that isolates the pool from the house
    2. removable mesh fencing (ASTM F2286) with a self-closing, self-latching gate
    3. a safety pool cover (ASTM F1346-23)
    4. exit alarms on doors and windows that open directly to the pool
    5. self-closing, self-latching devices on those doors, released at least 54 inches up
    6. a pool alarm (ASTM F2208; child-worn alarms don't count)
    7. other equally protective, independently verified means
  • Some pairs don't count, such as a safety cover plus a pool alarm. The building official inspects before final approval.
  • Enclosure standards (§115923): at least 60 inches high, no more than 2 inches of clearance at the bottom, gaps that won't pass a 4-inch sphere, no handholds or footholds, and gates that open away from the pool with self-latches at least 60 inches up.
  • What counts as a pool: any structure with water over 18 inches deep, including above-ground pools, hot tubs and spas (§115921). Spas with a locking ASTM F1346 cover, apartment complexes and public pools are exempt (§115925).
  • Small pools: the 2025 Residential Code exempts prefabricated pools under 24 inches deep from a building permit.
