Acton, Middlesex County · Bylaws checked 2026-10-19 · Reviewed · 9 cited sections

Allowed

Tool sheds are an allowed accessory use in Acton's residential districts, and you need a building permit only for a shed over 200 sq ft. Every shed, of any size, must meet zoning yard setbacks (for example 30 ft front and 10 ft side/rear in R-2, or 45 ft front and 20 ft side/rear in R-4 through R-10/8), plus wetland, septic and floodplain rules.

Allowed as an accessory use

Acton's Zoning Bylaw lists private garages, greenhouses, tool sheds and barns among the accessory uses allowed in residential districts [1]. A shed counts as a "structure" under the bylaw [5], so it has to meet the same yard setbacks as other buildings.

When you need a permit

The Building Department's shed handout says a building permit is only required for a shed over 200 sq ft. Even so, all sheds must comply with floodplain, zoning, wetland and septic setbacks [2]. For a permitted shed you'll apply online and submit a plot plan stamped by a registered land surveyor. A mortgage survey plan may be accepted case by case [8].

Setbacks

The Planning Department's setback guide (April 2019) lists "sheds of all sizes" among structures that must meet setbacks [3]. The current Table 1 of the Zoning Bylaw (May 2026) sets these minimums [4]:

  • R-2: 30 ft front, 10 ft side and rear
  • R-4, R-8, R-8/4, R-10, R-10/8: 45 ft front, 20 ft side and rear
  • R-A and R-AA: 30 ft front, 10 ft side and rear; VR: 10 ft front and side/rear

A corner lot has two front yards, and both must meet the front setback [7]. Maximum height in the residential districts is 36 ft [4]. We found no separate size or lot-coverage cap for sheds in R-2 through R-10/8 (open space is "NR" there). R-A and R-AA require 35% open space and VR 20%.

Near wetlands

The Conservation Commission treats a shed as a "structure" for its wetland setbacks [9]. Acton's Wetland Protection Bylaw requires a 75-ft setback from the edge of wetlands for structures [6]. The Commission can waive this. Any work within 100 ft of a resource area also falls under its jurisdiction.

Next steps

  1. Look up your zoning district on Acton's GIS viewer and mark the front, side and rear setbacks on a plot plan.
  2. Check for wetlands, streams or vernal pools within 100 ft and your septic system location; contact the Conservation Commission if near a wetland.
  3. If the shed is over 200 sq ft, apply for a building permit online with the Building Department (978-929-6633) with a surveyor-stamped plot plan showing the shed location.

Massachusetts building code rules for sheds

The Massachusetts State Building Code (780 CMR, 10th edition) sets when a shed needs a building permit. Your town's zoning sets where it can go.

  • No building permit needed for a one-story detached accessory structure used as a tool or storage shed, playhouse or similar, if the floor area is 200 sq ft or less (Residential Code R105.2).
  • Bigger sheds, or any with more than one story, need a building permit from your local building department.
  • Also exempt from a building permit: detached decks of 200 sq ft or less that are no more than 30 inches above grade, and greenhouses covered only in plastic film.
  • The exemption covers only the building permit. Electrical, plumbing or gas work in the shed still needs its own permits, and the shed still has to meet local zoning (setbacks, lot coverage, height). Many towns set accessory-structure setbacks even for small sheds.
  • Wetlands: putting a shed in a wetland resource area or within 100 feet of a wetland (or 200 feet of a river) may require Conservation Commission approval first, whatever its size.

The 10th edition took effect October 11, 2024 and has been the only code in force since July 1, 2025.
