Accessory Dwelling Units (ADUs) Yes. Acton allows one accessory dwelling unit (ADU) per lot as of right in single-family residential districts. It must be smaller than half the main home's gross floor area or 900 sq ft, whichever is smaller, and you need a building permit and an occupancy permit from the Building Commissioner.Allowed with a permit
Backyard Chickens We found no rule on backyard chickens in Acton's Zoning Bylaw, General Bylaws or Board of Health regulations (2022 version): no hen limit, rooster ban, coop setback or poultry permit. The Board of Health's animal rules cover only horses and stables, and zoning's farm protection is limited to commercial agriculture on parcels of 2 acres or more. Not specifically regulated
Short-Term Rentals (Airbnb / VRBO) Acton's bylaws we reviewed have no short-term rental bylaw, registration or license. The closest rules: a resident owner may rent rooms to up to 3 people (more with a Zoning Board of Appeals special permit), and a bed and breakfast needs a Select Board special permit in the main residential districts. Not specifically regulated
Fences Acton's Zoning Bylaw lets walls and fences no more than 8 feet tall sit inside the required front, side and rear yards, so a typical fence can go right up to the property line. A fence taller than 8 feet must meet the district's setbacks like other structures. We found no local fence permit requirement.Allowed
Sheds & Accessory Buildings Tool sheds are an allowed accessory use in Acton's residential districts, and you need a building permit only for a shed over 200 sq ft. Every shed, of any size, must meet zoning yard setbacks (for example 30 ft front and 10 ft side/rear in R-2, or 45 ft front and 20 ft side/rear in R-4 through R-10/8), plus wetland, septic and floodplain rules.Allowed
Burn Permits & Backyard Fires Yes, with a Fire Department permit from acton.firepermits.com. Brush burning is allowed January 15 to May 1, between 10 AM and 4 PM (no fire started after noon), at least 75 feet from any structure. You must activate the permit online each day you burn. Acton's own rules don't address backyard fire pits.Allowed with a permit
Home-Based Businesses Yes. Acton allows a home occupation by right if a resident runs it entirely inside the home or an accessory building, with no retail sales and no employees other than residents. Retail sales or up to 2 non-resident employees on site at a time need a special permit from the Zoning Board of Appeals.Allowed
Swimming Pools Yes, with a building permit from the Acton Building Department for any pool holding water over 24 inches deep, including in-ground, above-ground, hot tubs and spas. Pools must meet zoning yard setbacks (for example 30 ft front and 10 ft side/rear in R-2), plus wetland and septic setbacks, and Board of Health rules call for a 4-foot fence with a lockable gate.Allowed with a permit
Building Near the Water (Wetlands Rules) Work within 100 feet of a wetland, pond, stream or vernal pool in Acton needs Conservation Commission review under the town's Wetland Protection Bylaw. New structures, driveways and roads must stay at least 75 feet from the wetland edge, and a 50-foot strip of natural vegetation must be left undisturbed, unless the Commission grants a waiver.Allowed with board review
Docks, Piers & Floats Acton is an inland town with no harbor or dock bylaw. A dock, pier or float on a pond or stream is work in a protected wetland resource area, so it needs a Notice of Intent and an Order of Conditions from the Conservation Commission. Its fees are figured per linear foot of dock. Motorized boats are banned on Ice House Pond.Allowed with board review
