Fence height rules in Canton, Massachusetts
Canton's zoning lets you put a fence or wall up to 7 feet tall on the property line, in front, side or rear yards; anything taller must be set back from the line at least as far as it is tall. The town's Building Division page says fences 6 feet or less need no building permit, but the current state code exempts fences up to 7 feet, so ask the Building Department about a 6-7 ft fence. On corner lots, nothing may block traffic visibility within the 25-foot corner triangle.
| Max height on or within 7 ft of a lot line | 7 feet [1] |
| Taller fences/structures | Setback from lot line at least equal to height [1] |
| Building permit | Town page: not needed for fences 6 ft or less (state code exempts up to 7 ft) [3] |
| Corner sight triangle | 25 ft along each street line from the intersection [4] |
| Pool enclosure fence | At least 4 ft high, enclosing the whole pool [5] |
| Wetland buffer (30-100 ft) | No filing if not a wildlife barrier and outside the 30-ft No Build Zone [6] |
| Floodplain | Permit required for fences in the floodplain overlay district [7] |
Height and location
Canton's zoning bylaw has no separate front-yard and back-yard fence limits. Fences count as "structures" [2]. Under Section 4.3.2, a structure may sit in a required front, side or rear yard only if its height is no greater than its distance from the lot line. The exception is a fence or wall up to 7 feet tall, which may be on the lot line or within 7 feet of it [1]. A 6-foot privacy fence can therefore go right on the boundary. An 8-foot fence would have to be at least 8 feet in from the line. Fences in commercial and multifamily site plans can face separate screening rules. Retaining walls facing a designated scenic way are capped at 6 feet.
Corner lots
In residential districts, Section 4.2.3 sets a sight triangle formed by the two street lines and a line joining points 25 feet from their intersection. No structure, planting or other use may be placed there in a way that interferes with traffic visibility across the corner [4]. Keep corner fences low or open, or keep them out of the triangle.
Permits
The Building Division issues fence permits, and its page lists "Fences 6 feet in height or less" as work that does not require a building permit [3]. The current state building code (10th edition) exempts fences up to 7 feet, so that town page may be out of date. If your fence will be over 6 feet, ask the Building Department whether it needs a permit before you build. Zoning rules apply whether or not a permit is needed.
Pool fences
An outdoor residential pool that can hold more than 24 inches of water must be completely enclosed by a fence or wall at least 4 feet high, [5], with no gaps over 4 inches [8]. Gates must be self-closing and self-latching (see Pools).
Near wetlands and floodplains
Fences in the wetland buffer zone (30 to 100 feet from a wetland) need no Conservation Commission filing, as long as they aren't a barrier to wildlife and stay out of the 30-foot No Build Zone [6]. Any fence in the floodplain overlay district needs a permit [7].
The bylaw has no rule on materials or which side of the fence faces the neighbor.

Next steps
- Find your property lines (a certified plot plan or survey avoids disputes) and check whether you are on a corner lot.
- Keep the fence 7 ft or lower if it will be on or within 7 ft of the lot line, and keep corner fences out of the 25-ft sight triangle.
- For a fence over 6 ft, ask the Building Department (801 Washington St., 781-821-5003) whether a building permit is needed, and apply through Canton Online Permitting if so.
- If the fence is within 100 ft of a wetland or in a flood zone, check with the Conservation Commission (781-821-5035) or the Town Planner before installing.
Common questions
- How tall can a fence be in Canton, Massachusetts?
- Up to 7 feet on or near the property line, in front, side or rear yards. Anything taller must be set back from the lot line at least as far as it is tall, so an 8-foot fence would have to be at least 8 feet in.
- Do I need a permit for a fence in Canton, MA?
- It depends on height. The town's Building Division page says fences 6 feet or less need no building permit, but the current state code exempts fences up to 7 feet, so that page may be out of date. For a fence over 6 feet, ask the Building Department before you build.
- Are there fence rules for corner lots in Canton, Massachusetts?
- Yes. In residential districts nothing may block traffic visibility within the corner sight triangle, formed by the two street lines and a line joining points 25 feet from their intersection. Keep corner fences low or open, or out of the triangle.
- What are the pool fence requirements in Canton, MA?
- An outdoor residential pool that can hold more than 24 inches of water must be completely enclosed by a fence or wall at least 4 feet high, with no gaps over 4 inches. Gates must be self-closing and self-latching.
Massachusetts state rules on fences
Most fence rules in Massachusetts are local, set in your town's zoning bylaw and sometimes historic-district rules. A few state laws apply everywhere:
- Building permit: the State Building Code (780 CMR, 10th edition) does not require a building permit for fences 7 feet high or less. Taller fences need one. Zoning height limits and setbacks still apply, and many towns cap fences at 6 feet.
- Spite fences: under M.G.L. c. 49, §21, a fence that unnecessarily exceeds 6 feet and is maliciously put up or kept to annoy a neighbor is a private nuisance. The neighbor can sue for damages.
- Fence viewers: every town must appoint fence viewers each year (c. 49, §1). Where adjoining owners both enclose and use their land, they share the upkeep of the partition fence equally unless they agree otherwise. If one side won't repair their share, the other can complain to the fence viewers, who can order the repair (c. 49, §§3–4). By statute, a "legal and sufficient" fence is 4 feet high and in good repair (c. 49, §2).
- Pool fences must meet the state pool barrier rules (see Pools).
- Wetlands: fence work in a wetland or within 100 feet of one may need Conservation Commission review.
