Setbacks
Under zoning Section 4.2.5, in all residential districts a pool may be no nearer the street than the main building's required setback and no nearer than 10 feet to any abutting property line [1]. The Building Department's pool requirements repeat the 10-foot side and rear setback [7]. Pool houses, cabanas, filter houses and pool sheds must meet the accessory-structure setbacks (see Sheds). The Zoning Enforcement Officer checks pool locations on a certified plot plan before a permit is issued.
Fence and barrier
General By-Laws Art. XIV, §38 (1967) requires every outdoor residential pool that can hold more than 24 inches of water to be completely enclosed by a fence or wall at least 4 feet high [2]. The enclosure must surround the pool, walks and any diving platform. A building can form part of it, and a fence around the whole property also counts. Openings can be no larger than 4 inches [3]. Gates and doors in the enclosure must be self-closing and self-latching, with the latch at least 4 feet above the ground. A house door that forms part of the enclosure is exempt [4]. Portable pools that can't hold more than 24 inches need a safety cover when unattended [5]. The state building code's pool barrier rules also apply, and they are stricter in places: a 48-inch barrier, no more than a 2-inch gap under it over grass, gates that open outward, and alarms on house doors that open to the pool. The 1967 bylaw predates those rules, so build to whichever is stricter.
Permits
You need a building permit for a permanent pool [6]. The Building Department asks for:
- a certified plot plan showing the pool, accessory structures, any septic system and the enclosure fence
- the pool specifications
- a signed Swimming Pool Enclosure Affidavit. You agree to install the fence before filling the pool and to call for a final inspection.
In-ground pools need Conservation Commission sign-off [8]. An electrician must pull a wiring permit before the building permit is issued. Canton's bylaws have no separate rules for hot tubs or spas, so state code governs them.

Massachusetts building code rules for pools
Under the State Building Code (780 CMR, 10th edition), residential pools, spas and hot tubs must meet the 2021 International Swimming Pool and Spa Code (ISPSC) as adopted in Massachusetts.
Permits:
- A building permit is needed for any pool except prefabricated pools under 24 inches deep.
- Plans for in-ground pools must be prepared by a registered design professional (an engineer or architect).
- Wiring must meet the Massachusetts Electrical Code (527 CMR 12.00), and gas pool heaters must meet the state plumbing and gas code (248 CMR).
Barrier (fence) requirements (ISPSC §305):
- The barrier must be at least 48 inches high, measured on the side away from the pool.
- The gap under the barrier can be no more than 2 inches over grass or gravel, or 4 inches over concrete.
- Pedestrian gates must open outward away from the pool, be self-closing and self-latching, and be able to take a lock.
- If a house wall forms part of the barrier, doors and low windows opening to the pool need an audible alarm (or another listed option).
- In-ground pool construction sites need temporary fencing at least 4 feet high from excavation until the permanent barrier is up.
- Spas and hot tubs with a lockable safety cover meeting ASTM F1346, and pools with a powered safety cover meeting that standard, are exempt from the barrier rules.
Local zoning still controls pool setbacks, and wetlands rules may apply near water.
