Can I build an ADU in Wakefield, Massachusetts?
Yes. Wakefield's Zoning Bylaw allows one accessory dwelling unit per lot by right (building permit only, no special permit) in any district that allows single-family homes, attached or detached, up to 900 sq ft or half the main house's floor area, whichever is smaller. There is no owner-occupancy requirement, but neither the ADU nor the main house may be used as a short-term rental.
| Approval | As of right (building permit); no special permit or other discretionary ZBA approval [1] |
| Number allowed | One per lot [3] |
| Max size | 900 sq ft or half the main house's gross floor area, whichever is smaller (up to 1,200 sq ft by ZBA special permit) [5] |
| Owner-occupancy | Not required [4] |
| Short-term rental | ADU and its main house may not be used as a short-term rental [6] |
| Detached ADU setbacks | Accessory-building setbacks (rear yard, at least 7.5 ft from side and rear lot lines) [8] |
| Parking | None within 0.5 mile of a transit station; otherwise 1 space [9] |
Where and how
Wakefield calls these Protected Use Accessory Dwelling Units (PADUs). One PADU that meets the rules is allowed "as-of-right" as an accessory use to a principal dwelling, with no special permit or other discretionary approval from the Zoning Board of Appeals [1]. It applies in any single-family residential zoning district [3], which the bylaw defines as any district where single-family homes are allowed; the use table allows single-family homes in the SSR, SR, GR and NB districts [10]. You apply for a building permit with a site plan, floor plans and elevations [2].
Size and design
The unit can be attached or detached. It can't exceed 900 sq ft or half the main house's gross floor area, whichever is smaller; the Zoning Board of Appeals can allow up to 1,200 sq ft by special permit [5]. An ADU inside the house needs either a shared lobby or entry hall or its own exterior entrance. An attached ADU meets the house's setbacks; a detached one meets the accessory-building setbacks [7], which put it in the rear yard at least 7.5 ft from side and rear lot lines [8]. PADUs are exempt from building coverage, FAR and minimum lot size limits, and the existing house doesn't have to be brought into compliance. Garage space under a detached ADU isn't counted, and modular units are allowed.
Occupancy and rentals
There's no owner-occupancy, bedroom, tenant-number or family-relationship requirement [4]. You can rent the ADU long term, but the ADU and the main house it serves may not be used as a short-term rental [6]. Older accessory apartments approved by special permit or variance now count as PADUs and their old conditions no longer apply, but no additional ADU is allowed on those lots.
Parking
No parking is required if any part of the lot touches the half-mile radius around a transit station; otherwise one space is required [9]. An ADU that needs a parking space goes through ZBA Site Plan Approval, which may not impose unreasonable conditions. In the Floodplain District, the floodplain rules in §9.1 also apply.
State law
These rules track the state ADU law. The Attorney General's April 2026 decision on the recodified bylaw reminded the town to apply §8.1 consistently with G.L. c. 40A, §3 and 760 CMR 71.00 [11].

Next steps
- Confirm your lot is in a district that allows single-family homes (SSR, SR, GR or NB) and check whether it's in the Floodplain District.
- Prepare a site plan, floor plans and elevations showing all interior and exterior changes.
- Submit a Residential Building Permit application in person to the Building Inspector (Inspectional Services, 1 Lafayette Street, 781-246-6388).
- If the ADU needs a parking space, or you want more than 900 sq ft (up to 1,200) or setback relief, apply to the Zoning Board of Appeals for Site Plan Approval or a special permit.
Common questions
- Are ADUs allowed in Wakefield, Massachusetts?
- Yes. Wakefield's Zoning Bylaw allows one accessory dwelling unit per lot by right, with a building permit and no special permit, in any district that allows single-family homes (SSR, SR, GR and NB). It can be attached or detached.
- How big can an ADU be in Wakefield, MA?
- An ADU can be no larger than 900 sq ft or half the main house's gross floor area, whichever is smaller. The Zoning Board of Appeals can allow up to 1,200 sq ft by special permit.
- Do I have to live on the property to have an ADU in Wakefield, Massachusetts?
- No. Wakefield's bylaw has no owner-occupancy, bedroom, tenant-number or family-relationship requirement for an ADU. You can rent it long term.
- Can I Airbnb my ADU in Wakefield, MA?
- No. Wakefield's Zoning Bylaw says neither the ADU nor the main house it belongs to may be used as a short-term rental.
- Does an ADU need parking in Wakefield, Massachusetts?
- It depends on location. No parking is required if any part of the lot touches the half-mile radius around a transit station; otherwise one space is required, and an ADU that needs a space goes through ZBA Site Plan Approval.
Massachusetts' statewide ADU law
Since February 2, 2025, the Affordable Homes Act (St. 2024, c. 150, §8) has protected one accessory dwelling unit (ADU) per lot in any zoning district that allows single-family homes (M.G.L. c. 40A, §3). Your town cannot ban it, require a special permit or other discretionary approval, or "unreasonably restrict" building or renting it.
What counts as a protected ADU:
- A self-contained unit with its own sleeping, cooking and bathroom facilities, on the same lot as the main home.
- No larger than 900 sq ft or half the main home's floor area, whichever is smaller.
- It can be attached or detached, and it needs a separate entrance that meets the building code.
What towns cannot require:
- That the owner live in the main home or the ADU.
- More than 1 extra parking space, or any extra space if the lot is within 0.5 miles of a subway, commuter rail, ferry or bus station.
- A minimum lot size, caps on the number of ADUs, or limits on who may live there (age, income, relationship).
What towns can still do: use reasonable site plan review, setback, height and bulk rules, require Title 5 septic compliance, and restrict or ban short-term rentals of ADUs. A second ADU on the same lot needs a special permit. State regulations at 760 CMR 71.00 (in effect since January 31, 2025) explain which rules count as unreasonable.
