Wakefield, Massachusetts: what can you build or do?
Plain-English answers to common homeowner questions, taken from Wakefield's published bylaws, with every rule linked to the section it comes from.

Accessory Dwelling Units (ADUs) Yes. Wakefield's Zoning Bylaw allows one accessory dwelling unit per lot by right (building permit only, no special permit) in any district that allows single-family homes, attached or detached, up to 900 sq ft or half the main house's floor area, whichever is smaller. There is no owner-occupancy requirement, but neither the ADU nor the main house may be used as a short-term rental.Allowed with a permit
Backyard Chickens Yes, with a Board of Health license. Wakefield bans roosters, requires you to notify abutters by certified mail before the Board acts, and requires the henhouse and pen to be at least 50 feet from any dwelling (including your own), 50 feet from an abutter and 20 feet from any street. The number of hens depends on coop space (2 sq ft per chicken), and the license costs $50 to start and $15 a year to renew.Allowed with a permit
Short-Term Rentals (Airbnb / VRBO) We found no Wakefield short-term rental registration, license or fee on the town website. The Zoning Bylaw bans short-term rentals in an accessory dwelling unit and the house it belongs to, throughout the MBTA Communities overlay, and in certain homes built on formerly merged lots, but it doesn't say whether an ordinary single-family home outside those cases may be rented short term. Wakefield's General Bylaws (posted only on eCode360) weren't reviewed and could contain other rules, so ask the Building Inspector in writing before listing.Restricted
Fences Wakefield's Zoning Bylaw has no general fence-height limit. In the front yard, a fence, wall or hedge within 5 feet of the front lot line can't be over 2½ feet tall unless you show it won't block drivers' views at driveways or corners, and any fence in the Floodplain Overlay needs a Zoning Board of Appeals special permit. We didn't review Wakefield's General Bylaws (posted only on eCode360), which could contain other fence rules.Allowed
Sheds & Accessory Buildings A storage shed is an allowed accessory use in Wakefield up to 1,200 sq ft and 25 feet tall. A detached shed may go in the rear yard at least 7.5 feet from the side and rear lot lines, and in the SR and SSR districts it must also be at least 20 feet from any house on a neighboring lot. Under the State Building Code a one-story shed of 200 sq ft or less doesn't need a building permit; larger sheds need one, filed in person with a plot plan and drawings (or a brochure picture).Allowed with a permit
Burn Permits & Backyard Fires Brush burning is allowed in Wakefield only from January 15 to May 1, between 10 am and 4 pm, at least 75 feet from buildings, with a permit from the Fire Department: call 781-246-6432 on every day you plan to burn. The Fire Department says fire pits and recreational fires are allowed year-round if they stay no more than 3 feet across, are attended at all times and have 75 feet cleared around them. State rules treat a fire pit used for anything other than cooking as open burning, so state law may limit that year-round allowance; ask the Fire Prevention Office.Allowed with a permit
Home-Based Businesses In most Wakefield residential districts, a few home occupations are allowed by right (dressmaking, tutoring up to two students at a time, and offices of doctors, dentists, attorneys, architects or CPAs), and other quiet, noncommercial ones need a Zoning Board of Appeals special permit. The business can use no more than 25% of the home's floor area (700 sq ft max), with one sign of up to 2 sq ft. The use table marks home occupations as prohibited in the Special Single Residence (SSR) district, which conflicts with another section, so SSR owners should check with the Building Inspector.Depends on your zone
Swimming Pools A private pool is an allowed accessory use at a Wakefield single-family home if it's completely enclosed by a fence or barrier with self-latching gates. A pool over 24 inches deep can't be within 30 feet of any street line, in a required side yard, or within 7.5 feet of the rear lot line. Barrier height follows the State Building Code (at least 48 inches), and the building permit application needs a plot plan and drawings.Allowed with a permit
Building Near the Water (Wetlands Rules) Wakefield's Conservation pages describe only the state Wetlands Protection Act, which the Conservation Commission applies: any project within 100 feet of a wetland or 200 feet of a perennial stream or river needs Commission review first. Zoning also bars any building or structure within 50 feet of an open stream's embankment and requires a ZBA special permit for all development in the Floodplain Overlay District. A local wetlands bylaw (with a 25-foot no-build zone) is only a proposal for the November 16, 2026 Town Meeting and isn't in effect.Allowed with board review
Docks, Piers & Floats We found no Wakefield rules specifically for private docks, piers or floats in the Zoning Bylaw, Conservation pages or recent Town Meeting warrants; Wakefield's General Bylaws (posted only on eCode360) weren't reviewed and could contain some. A dock still counts as a "structure" under zoning, needs Conservation Commission review under the state Wetlands Protection Act, and may need a state Chapter 91 license, so contact the Conservation office before installing one.Not specifically regulated
