Do I need a permit for a shed in Walpole, Massachusetts?

Walpole, Norfolk County · Bylaws checked 2026-10-15 · Reviewed · 10 cited sections

Allowed

Tool sheds are allowed by right as accessory buildings in every Walpole zoning district. A detached shed 15 feet tall or less needs only 10 feet from the rear lot line, but on most lots it must meet the district's full side setback (25 ft Rural, 20 ft Residence A, 15 ft Residence B, 10 ft General Residence); the reduced 6-foot side setback applies only if the shed sits at least 100 feet back from the front lot line. Sheds over 22 x 24 feet or 15 feet high must meet the full setbacks for a main building.

Allowed by right

The zoning use table lists accessory buildings such as a greenhouse, stable, tool shed, playhouse or similar building for domestic storage as allowed (A) in every district [1].

Setbacks

Footnote 3 to the dimensional table gives detached accessory buildings 15 feet tall or less a reduced rear setback of 10 feet, wherever they sit on the lot [2]. The side setback is stricter. Footnote 4 allows a 6-foot side setback only for a small accessory building "having a front yard setback of at least one-hundred (100) feet" [3]. On a typical lot, where the shed would be less than 100 feet from the street, the plain reading is that the district's ordinary side setback applies: 25 feet in Rural [7], 20 feet in Residence A [8], 15 feet in Residence B [9] and 10 feet in General Residence [10]. The front setback is 30 feet in all four districts, and Section 6-C.8 keeps structures out of required setbacks except for listed items such as fences, walls and pools.

An unclear sentence

Footnote 4's last sentence says a detached accessory building taller than 15 feet must meet the "front yard setback", even though the footnote is about side lines [3]. It probably means the side setback, but the text doesn't say so. Taller or larger sheds have to meet the district's normal dimensional rules either way (see below), so ask the Building Department how it applies Footnote 4 before you pick a spot.

Size and height

The definitions treat an accessory building as one no larger than 22 by 24 feet and no taller than 15 feet; anything bigger must meet the district's full dimensional requirements [4]. Accessory structures may not exceed 40% of the main building's gross floor area or contain sleeping or kitchen facilities [5].

Permits and special areas

The zoning bylaw doesn't set a building-permit size threshold for sheds; the state building code rule shown on this page applies. In the Flood Plain Protection Overlay District, sheds need a Board of Appeals special permit [6], and sheds near wetlands may need Conservation Commission review.

Next steps

  1. Measure the planned spot: at least 10 feet from the rear line, and the district side setback (25/20/15/10 ft in R/RA/RB/GR) unless the shed is 100+ feet back from the front lot line, in which case 6 feet.
  2. Keep the shed 15 feet tall or less and within 22 x 24 feet to use the reduced setbacks.
  3. Check whether the lot is in the floodplain overlay or within 100 feet of a wetland.
  4. Ask the Building Department (508-660-6348) whether your shed needs a building permit and bring a plot plan showing the distances to lot lines.

Common questions

Do I need a permit for a shed in Walpole, Massachusetts?
It depends. Sheds are allowed by right in every zoning district, and the zoning bylaw sets no building-permit size threshold; the state building code rule applies. Ask the Building Department whether your shed needs a permit and bring a plot plan.
How close to the property line can a shed be in Walpole, Massachusetts?
A shed 15 feet tall or less needs 10 feet from the rear line. On most lots it must meet the district side setback (25 ft Rural, 20 ft Residence A, 15 ft Residence B, 10 ft General Residence); 6 feet applies only if it sits 100+ feet back from the front lot line.
Is the shed side setback rule clear in Walpole, Massachusetts?
Not entirely. Footnote 4's last sentence says a detached accessory building over 15 feet must meet the "front yard setback," though the footnote concerns side lines; it probably means side setback, but the text doesn't say. Ask the Building Department how it applies Footnote 4 before picking a spot.
How big can a shed be in Walpole, Massachusetts?
To use the reduced setbacks, a shed must be within 22 x 24 feet and 15 feet high; larger sheds must meet the full setbacks for a main building. Accessory structures can't exceed 40% of the main building's gross floor area or contain sleeping or kitchen facilities.
Can I put a shed in a floodplain in Walpole, Massachusetts?
Only with approval. In the Flood Plain Protection Overlay District, sheds need a Board of Appeals special permit, and sheds near wetlands may need Conservation Commission review.

Massachusetts building code rules for sheds

The Massachusetts State Building Code (780 CMR, 10th edition) sets when a shed needs a building permit. Your town's zoning sets where it can go.

  • No building permit needed for a one-story detached accessory structure used as a tool or storage shed, playhouse or similar, if the floor area is 200 sq ft or less (Residential Code R105.2).
  • Bigger sheds, or any with more than one story, need a building permit from your local building department.
  • Also exempt from a building permit: detached decks of 200 sq ft or less that are no more than 30 inches above grade, and greenhouses covered only in plastic film.
  • The exemption covers only the building permit. Electrical, plumbing or gas work in the shed still needs its own permits, and the shed still has to meet local zoning (setbacks, lot coverage, height). Many towns set accessory-structure setbacks even for small sheds.
  • Wetlands: putting a shed in a wetland resource area or within 100 feet of a wetland (or 200 feet of a river) may require Conservation Commission approval first, whatever its size.

The 10th edition took effect October 11, 2024 and has been the only code in force since July 1, 2025.
