Allowed with a permit

Pools are allowed as accessory structures in Walpole. The zoning bylaw lets in-ground and above-ground pools sit inside the side and rear setbacks as long as the pool edge (or, for an above-ground pool, the edge of its elevated deck) is at least 6 feet from the lot line. Pool barrier and building permit rules come from the state code shown on this page.

Setbacks

Section 6-C.8 of the zoning bylaw normally keeps structures out of required setbacks, but makes an exception for pools. In-ground pools may be located in the side and rear yard setbacks if the edge of the pool is at least 6 feet from the lot line; above-ground pools may be located there if the edge of the elevated deck is at least 6 feet from the lot line [1]. The exception covers side and rear yards only, so a pool can't go in the front setback, which is 30 feet in the Rural, Residence A, Residence B and General Residence districts [5].

Pools are structures

The bylaw's definition of "structure" expressly includes swimming pools [2], so a pool counts toward the general rules for structures on your lot.

Excavation

Digging for a pool is covered by Section 5-D. Excavation incidental to swimming pools and other accessory uses is allowed as long as the material removed does not exceed what is needed to install the permitted features [3]. Clear-cutting or stripping topsoil before the building permit is issued is prohibited.

Special areas

If your lot is in the Flood Plain Protection Overlay District, any construction there needs a special permit from the Board of Appeals [4]. A pool within 100 feet of a wetland, or within 200 feet of a year-round river or stream, also needs Conservation Commission review under the town's wetlands bylaw.

Not covered locally

The zoning bylaw has no separate pool fencing, hot tub or permit section; the state building code rules for pool permits and barriers shown on this page apply.

Next steps

  1. Draw a plot plan showing the pool edge (or the edge of an above-ground pool's deck) at least 6 feet from side and rear lot lines and outside the front setback.
  2. Check whether the lot is in the floodplain overlay or near wetlands; if so, contact the Zoning Board of Appeals or Conservation Commission (508-660-7268) first.
  3. Apply to the Building Department (508-660-6348) for the pool building permit, with the barrier (fence) design and electrical work.

Common questions

How close to the property line can a pool be in Walpole, Massachusetts?
An in-ground pool's edge, or an above-ground pool's elevated deck edge, must be at least 6 feet from side and rear lot lines. Pools can't go in the front setback, which is 30 feet in residential districts.
Do I need a permit for a pool in Walpole, Massachusetts?
Yes. Pool building permit and barrier rules come from the state building code; apply to the Building Department with the barrier design and electrical work. Walpole's zoning bylaw has no separate pool permit section.
Do you need a fence around a pool in Walpole, Massachusetts?
Walpole's zoning bylaw has no pool fencing section. Pool barrier requirements come from the state building code.
Can I build a pool near wetlands in Walpole, Massachusetts?
Only with review. A pool within 100 feet of a wetland, or 200 feet of a year-round river or stream, needs Conservation Commission review, and any construction in the Flood Plain Protection Overlay District needs a Board of Appeals special permit.

Massachusetts building code rules for pools

Under the State Building Code (780 CMR, 10th edition), residential pools, spas and hot tubs must meet the 2021 International Swimming Pool and Spa Code (ISPSC) as adopted in Massachusetts.

Permits:

  • A building permit is needed for any pool except prefabricated pools under 24 inches deep.
  • Plans for in-ground pools must be prepared by a registered design professional (an engineer or architect).
  • Wiring must meet the Massachusetts Electrical Code (527 CMR 12.00), and gas pool heaters must meet the state plumbing and gas code (248 CMR).

Barrier (fence) requirements (ISPSC §305):

  • The barrier must be at least 48 inches high, measured on the side away from the pool.
  • The gap under the barrier can be no more than 2 inches over grass or gravel, or 4 inches over concrete.
  • Pedestrian gates must open outward away from the pool, be self-closing and self-latching, and be able to take a lock.
  • If a house wall forms part of the barrier, doors and low windows opening to the pool need an audible alarm (or another listed option).
  • In-ground pool construction sites need temporary fencing at least 4 feet high from excavation until the permanent barrier is up.
  • Spas and hot tubs with a lockable safety cover meeting ASTM F1346, and pools with a powered safety cover meeting that standard, are exempt from the barrier rules.

Local zoning still controls pool setbacks, and wetlands rules may apply near water.
