Allowed with a permit

Sheds are allowed by right as accessory uses in Needham's residential districts. A shed must be at least 5 ft from side and rear lot lines and 10 ft from other buildings, and a shed taller than 15 ft must meet the full district side and rear setbacks. The use table lists "other customary and proper accessory uses, such as, but not limited to, garages, tool sheds, greenhouses and cabanas" as allowed (Y) in every district column of the table, including all residential districts [1]. A shed is a building under the bylaw because it has a roof sheltering property [7].

Setbacks and spacing

Section 4.2.9 says no accessory building or structure (other than fences) may be closer than 10 ft to any other building or structure or 5 ft to the side or rear lot lines. If the accessory building is more than 15 ft tall, it must meet the district's regular side and rear setbacks [2]. The section doesn't relax front setbacks, so a shed in front of the house has to meet the front setback for the district, listed in the dimensional tables in Section 4.2. The zoning definition of "structure" excludes items under 100 sq ft and under 8 ft tall [6], but a roofed shed still counts as a building.

Size, height and coverage

There's no shed-specific size cap. Sheds count toward maximum lot coverage, which is the portion of a lot covered by any building or structure [4]; in Single Residence B the cap is 30% for lots under 5,500 sq ft, stepping down to 25% for lots of 7,500 sq ft or more [5]. District height limits also apply (35 ft when measured from grade) [8].

Permits

Under Section 7.2.1, no building or structure may be constructed or relocated without a permit from the Building Commissioner, and applications need a plot plan showing the lot and all buildings [3]. The state building code separately exempts one-story storage sheds of 200 sq ft or less from a building permit, so ask the Building Department which approval applies to a small shed. In the Flood Plain District, sheds need a special permit from the Board of Appeals, and sheds near wetlands may need Conservation Commission review.

Massachusetts building code rules for sheds

The Massachusetts State Building Code (780 CMR, 10th edition) sets when a shed needs a building permit. Your town's zoning sets where it can go.

  • No building permit needed for a one-story detached accessory structure used as a tool or storage shed, playhouse or similar, if the floor area is 200 sq ft or less (Residential Code R105.2).
  • Bigger sheds, or any with more than one story, need a building permit from your local building department.
  • Also exempt from a building permit: detached decks of 200 sq ft or less that are no more than 30 inches above grade, and greenhouses covered only in plastic film.
  • The exemption covers only the building permit. Electrical, plumbing or gas work in the shed still needs its own permits, and the shed still has to meet local zoning (setbacks, lot coverage, height). Many towns set accessory-structure setbacks even for small sheds.
  • Wetlands: putting a shed in a wetland resource area or within 100 feet of a wetland (or 200 feet of a river) may require Conservation Commission approval first, whatever its size.
