Short-term rental (Airbnb) rules in Needham, Massachusetts
Needham's bylaws we reviewed have no short-term rental license or registration and don't directly address renting a whole house on Airbnb or VRBO. No general short-term rental bylaw
We found no short-term rental registration, license, fee, cap or minimum-stay rule in Needham's Zoning By-Law (amended to May 2025) or General By-Laws (July 2023 compilation). The Zoning By-Law defines a dwelling as excluding hotels, motels, boarding houses and structures solely for transient or overnight occupancy [1], but it doesn't list or define short-term rentals of a home. Because the bylaws are silent, renting out your main home short-term is mainly governed by state rules (registration with the Department of Revenue, room occupancy taxes and insurance). This doesn't mean the town has approved the use, so confirm with the Building Commissioner before listing.
Accessory dwelling units
The one clear local rule involves ADUs. A tenant of an ADU or of the main house on an ADU property must be a Lessee with a written lease of at least six months, and the lease must prohibit subleasing, assigning, or offering the space short-term on Airbnb or any other venue; the lease must be filed with the Building Commissioner before the ADU's occupancy permit issues [2]. At least one unit must be Owner-occupied [4]. In practice, this bars short-term rental of either unit on a property with an ADU. Massachusetts law lets towns restrict short-term rentals of ADUs, though state law may override the owner-occupancy requirement.
Renting rooms
The use table lists "the taking of not more than four non-transient boarders or the leasing of not more than two rooms with no provisions for private cooking by a resident family in a single-family dwelling" as SP (special permit) in the Rural Residence-Conservation, Single Residence A and B, and General Residence districts; it is allowed by right only in the A-1/2/3 apartment districts [3]. Special permits under the Zoning By-Law are generally decided by the Board of Appeals. Because the boarders must be non-transient, this provision is about longer-term lodgers rather than nightly guests.

The General By-Laws copy we reviewed is a July 2023 compilation and the zoning printing may not include October 2025 Town Meeting changes, so check with the Town Clerk for any newer short-term rental bylaw.

Massachusetts' short-term rental law
Since July 1, 2019, M.G.L. c. 64G has taxed and regulated short-term rentals: stays of 31 days or less in a home, apartment, condo or room booked in advance.
State requirements:
- Register with the Department of Revenue (DOR) on MassTaxConnect and get a Certificate of Registration for each property. Post it in the unit.
- 14-day exemption: if you rent a property 14 days or fewer in a calendar year, no tax is due. You still have to register and file DOR's declaration by January 15 each year. Go over 14 days and you owe tax on every day, including the first 14.
- State room occupancy excise: 5.7% of rent (including cleaning and booking fees).
- Local taxes on top, if your town has adopted them: a local excise of up to 6% (6.5% in Boston), and a community impact fee of up to 3%. The fee applies to "professionally managed" units (an operator with 2 or more units in a town, other than units in the owner's own 1 to 3 family home) and, by separate vote, to units in an owner-occupied 2 or 3 family house. Barnstable County towns add 2.75% for a regional water fund.
- Insurance: at least $1 million liability coverage per unit, unless the booking platform provides equal coverage (c. 175, §4F).
Towns may go further (c. 64G, §14). They can require local licenses and inspections, cap the number of days or units, limit where rentals are allowed, or ban them entirely.
