Accessory Dwelling Units (ADUs) Under Needham's Zoning By-Law (version amended to May 2025; rules may have changed since), one accessory dwelling unit is allowed inside a single-family detached house with a building permit from the Building Commissioner. It's capped at 900 sq ft of living space and one bedroom, and the bylaw still requires one of the two units to be owner-occupied and bars ADUs in accessory buildings, rules that Massachusetts' ADU law (in effect since Feb 2, 2025) may override.Allowed with a permit
Backyard Chickens Yes, with a Keeping of Animals permit from the Needham Public Health Department. The base allowance is one Animal Unit, which equals 4 chickens; more need approval, roosters need a specific permit, and the coop and run must sit at least 30 ft from side and rear lot lines and 50 ft from any neighboring house.Allowed with a permit
Short-Term Rentals (Airbnb / VRBO) Needham's bylaws we reviewed have no short-term rental license or registration and don't directly address renting a whole house on Airbnb or VRBO. They do block short-term rentals of accessory dwelling units: any ADU lease must run at least six months and must prohibit Airbnb-style subletting. Taking up to four non-transient boarders or renting two rooms requires a special permit in residential districts.Restricted
Fences Needham's bylaws we reviewed set no general height limit for residential fences, and fences are exempt from zoning setbacks, so they can go on the property line. The main local limits are a 25-foot sight triangle at street corners, where nothing may block drivers' view, and a special permit for fences in the Flood Plain District.Allowed
Sheds & Accessory Buildings Sheds are allowed by right as accessory uses in Needham's residential districts. A shed must be at least 5 ft from side and rear lot lines and 10 ft from other buildings, and a shed taller than 15 ft must meet the full district side and rear setbacks. Needham's Zoning By-Law says no building may be built without a permit from the Building Commissioner, so check with the Building Department even for a small shed.Allowed with a permit
Burn Permits & Backyard Fires Brush burning is allowed only during the January 15 to May 1 season, with a $10 permit from the Needham Fire Department at 88 Chestnut Street, between 10am and 4pm. Before burning each day you must call the Fire Department (781-444-0142) for permission. The town materials we reviewed don't address backyard fire pits.Allowed with a permit
Home-Based Businesses Yes. Needham's Zoning By-Law allows two kinds of home businesses by right in single-family and two-family homes: a resident professional's office or studio using no more than 25% of the floor area (600 sq ft max) with at most one employee, and a customary home occupation such as crafts or small repairs with at most one employee, no outdoor storage, and no advertising, signs or on-site sales.Allowed
Swimming Pools Pools are allowed with a permit from the Building Commissioner. Under Needham's Zoning By-Law, a pool 2 ft or deeper or with at least 100 sq ft of water surface counts as a structure, so as an accessory structure it must be at least 5 ft from side and rear lot lines and 10 ft from other buildings. Pools don't count toward lot coverage, and barrier and fence rules come from the state building code.Allowed with a permit
Building Near the Water (Wetlands Rules) Work within 100 feet of a wetland, bank, pond, river or stream, or on land subject to flooding, needs a permit from the Needham Conservation Commission under the town's Wetlands Protection By-Law. The Commission's regulations bar any regulated activity within 25 feet of wetlands and water bodies, or 50 feet where the area provides wildlife habitat (presumed unless shown otherwise) or is undeveloped, unless the Commission grants a waiver.Allowed with board review
Docks, Piers & Floats Needham has no separate dock or harbor bylaw, but a dock, pier or float in any pond, river or stream is regulated by the Conservation Commission under the town's Wetlands Protection By-Law, so you need a Commission permit first. The bylaw and regulations set no dock size limits; the Commission reviews each project against its standards for water bodies and the 25-foot no-disturb zone.Allowed with board review
