Allowed with a permit

Is your pool a structure?

These rules come from the Zoning By-Law as amended to May 2025 (printed November 2025); later changes may not be reflected.

Needham's zoning definition of "structure" includes a constructed swimming pool with water two feet deep or more, or a water surface of at least 100 sq ft when full [1]. Most in-ground pools and larger above-ground pools meet that test, so they follow the accessory structure rules below. A small, shallow wading pool falls below both thresholds.

Setbacks

An accessory structure must be at least 5 ft from the side and rear lot lines and 10 ft from any other building or structure; anything over 15 ft tall must meet the full district setbacks [2]. A pool-related accessory building such as a cabana or pump house that is under 11 ft tall and under 100 sq ft of ground coverage can be as close as 8 ft to the pool's edge instead of 10 ft [3]. Front-yard setbacks for your district still apply.

Lot coverage

Pools, decks and patios are excluded from lot coverage [4], so a pool won't count against your district's coverage cap. Pools are, however, treated as impervious surface under the town's stormwater bylaw, so ask whether a stormwater plan is needed.

Permits and overlay districts

No building or structure may be built without a permit from the Building Commissioner, and the application needs a plot plan drawn to scale (1 inch = 40 ft) showing the lot and all buildings and structures [5]. In the Flood Plain District, swimming pools and their accessory structures, walkways, equipment and fences need a special permit from the Board of Appeals [6]. In the Aquifer Protection District, pools or ponds created for swimming need a special permit from the Planning Board [7]. Pools near wetlands may also need Conservation Commission approval.

Barriers and hot tubs

The Zoning By-Law doesn't set pool fence or barrier standards or address hot tubs. Those come from the state building code (48-inch barrier, self-closing and self-latching gates).

Massachusetts building code rules for pools

Under the State Building Code (780 CMR, 10th edition), residential pools, spas and hot tubs must meet the 2021 International Swimming Pool and Spa Code (ISPSC) as adopted in Massachusetts.

Permits:

  • A building permit is needed for any pool except prefabricated pools under 24 inches deep.
  • Plans for in-ground pools must be prepared by a registered design professional (an engineer or architect).
  • Wiring must meet the Massachusetts Electrical Code (527 CMR 12.00), and gas pool heaters must meet the state plumbing and gas code (248 CMR).

Barrier (fence) requirements (ISPSC §305):

  • The barrier must be at least 48 inches high, measured on the side away from the pool.
  • The gap under the barrier can be no more than 2 inches over grass or gravel, or 4 inches over concrete.
  • Pedestrian gates must open outward away from the pool, be self-closing and self-latching, and be able to take a lock.
  • If a house wall forms part of the barrier, doors and low windows opening to the pool need an audible alarm (or another listed option).
  • In-ground pool construction sites need temporary fencing at least 4 feet high from excavation until the permanent barrier is up.
  • Spas and hot tubs with a lockable safety cover meeting ASTM F1346, and pools with a powered safety cover meeting that standard, are exempt from the barrier rules.

Local zoning still controls pool setbacks, and wetlands rules may apply near water.
