Accessory Dwelling Units (ADUs) Yes. Winchester's November 2024 ADU amendment (partly approved by the Attorney General in June 2025) allows one ADU by right on a lot with a home, attached or in a detached accessory building, up to 900 sq ft or half the main home's floor area, whichever is less. ADUs go through site plan review, need one off-street parking space unless within a half mile of a commuter rail or bus station, and can't be used as short-term rentals.Allowed with board review
Backyard Chickens Yes, hens are allowed with a Board of Health permit. You need at least 6,500 sq ft of lot for 3 hens (up to 6 on larger lots in most residential zones); roosters are banned, and the coop must be in the backyard at least 10 ft from lot lines and 20 ft from any home.Allowed with a permit
Sheds & Accessory Buildings Yes. A tool shed, greenhouse or similar accessory structure up to 150 sq ft is allowed by right in Winchester's residential districts. In the RDA, RDB, RDC and RG districts it can sit in the required rear yard if it's at least 5 ft from every property line, no more than 1.5 stories, at least 15 ft from other buildings, and (with other accessory buildings) covers no more than 30% of the rear yard. In the RA and RB districts, sheds can't go in any required yard. These rules come from the 2018 bylaw and may have changed.Allowed
Burn Permits & Backyard Fires Brush burning is allowed only from January 15 to May 1, 10 a.m. to 4 p.m., with a free permit you request by phone from the Winchester Fire Department, and at least 75 ft from any dwelling. Portable fire pits, chimineas and outdoor fireplaces are allowed year-round without a permit under the Fire Department's fire-pit rules if the fire is 3 ft across or less and 25 ft from structures, though another department page ties non-cooking fire pits to the burn season, so confirm first.Allowed with a permit
Home-Based Businesses Yes. A home occupation run by family members who live there is allowed by right in Winchester's residential districts, using no more than 25% of the home's floor area, with no product sales and at most one 2 sq ft unlit sign. If clients or pupils come to your house, you need a special permit.Allowed
Swimming Pools Yes. Uncovered swimming pools are allowed in Winchester's residential districts, but no part of the water or pool equipment may be in a required yard, the water must be at least 10 ft from any building, and the pool must be fully enclosed by a fence at least 5 ft high with self-latching gates. You can't fill it until a Certificate of Occupancy is issued.Allowed with a permit
Building Near the Water (Wetlands Rules) Any building, grading, filling or tree removal within 100 ft of a wetland, pond, river or stream in Winchester needs a permit from the Conservation Commission under the town Wetlands Bylaw. Within 25 ft of the water, the Commission presumes no alteration at all, including structures, will be allowed except for narrow listed exceptions.Allowed with board review
Docks, Piers & Floats Winchester has no separate dock bylaw; a dock, pier or float on a pond, lake or river is work on land under water and within 100 ft of a bank, so it needs a Conservation Commission permit under the Wetlands Bylaw. The Commission's buffer rules allow docks within the 25-ft buffer only where docks are allowed on that waterbody.Allowed with board review
